I disagree with George Leef that Drexel University Law Professor David S. Cohn’s demand for the repeal of the Second Amendment is weak.
Of course, it is outdated.
It reads, "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be infringed.”
It was written for the conditions that existed at the time it was adopted in 1791, when the new Republic was formed.
Before the Revolutionary War, the British tried to disarm colonists to rule them. That was a danger colonists feared.
The Continental Army under George Washington, which fought the British was made up of enlisted men and members of the militias from the thirteen colonies: soldiers furnished or purchased their rifle. The most common used gun was a single shot musket with a bayonet.
After the Revolutionary War and colonists won their independence from the British, the Continental Army was disbanded and that left the new Free State for its defense, mostly, on the militias of the thirteen colonies.
James Madison said in 1788, "The right of the people to keep and bear arms shall not be infringed. A well regulated militia, composed of the body of the people, trained to arms, is the best and most natural defense of a free country."
That was the mind set -- then.
And, the Second Amendment was adopted in 1791.
The new born free State faced many dangers: the lack of law enforcement, settlers were fighting with Indians, the borders were undefined and unsecured, the movement of the northern free states to abolish slavery did not set well with the southern slave states, states feared the growing power of the federal government, people feared the government might become tyrannical, and it had no standing army for defense, other than state militias, against hostile foreign powers that might claim its territories.
So, state trained and regulated militias made up of citizen soldiers were left to deal with these perceived dangers until the first standing peacetime US Army was form in 1796, which fought the War of 1812.
But, the reality of things has radically changed since the 18th century: it is a different world, but the law is the same.
Then, it took a trained shooter 20 seconds to reload a musket. Today, there are machine guns that can fire 500 to 1000 rounds a minute.
Then, there was gun powder, but, today there are high powered explosives that can be made into bombs: that was not even considered in 1791.
The Second Amendment is so obsolete: it never considered the possibility mentally disturbed individuals and radical Islamic terrorists would used assault weapons and belts, vests, shoes, laptops, and backpack bombs to target and kill civilians assembled in public places: theaters, airports, churches, schools, hotels, restaurants, on airplanes, trains and buses, etc; even, more destructive to life and property: car bombs.
For those reasons and others: the Second Amendment needs to be repealed and rewritten to fit realities that exist today.
Today, we have the US Army, Navy, Air Force, Marines, Coast Guard, National Guard, State Guards, the Army Reserves, the Department of Homeland Security, Bureau of Alcohol, Tobacco, Firearms, and Explosives, US Customs and Border Protection, TSA Agents, and Federal Air Marshals to protect us from psychopaths, criminals, riots, terrorist attacks, foreign nation attacks, and white supremacist groups, such as: the American Nazi Party, that want to replace our Free State with their government, if, they are able to stockpile enough weapons and convince enough people to join their cause.
These are real and potential dangers.
The Free State is no longer dependent on citizens with guns for its protection: they are not trained and well regulated, and do not have communication and surveillance equipment, trucks for transportation, supply depots, tanks, destroyers, planes, bombs, attack helicopters, and armed drones to respond to armed rebellion, terrorist attacks, attacks by hostile foreign powers, and help defend other nations from evil forces.
Citizens with AR-15 assault weapons that quickly form into militia cannot meet any of these challenges.
But, the big difference, Today, these high powered assault weapons and explosive are being used by people, who are deranged, terrorists, suicide bombers, criminals, and anti-government groups, not to become part of a well regulated militia to defense this nation; but, to engage in criminal activity, extortion, murder, armed robbery, and others radicalized by militant Islamic groups to kill as many people as possible, steal their property, and frighten the rest into submission in order to set an Islamic State. That was not envisaged by drafters of the Bill of Rights containing the Second Amendment.
And, these idiots in U.S. congress, servants of the NRA and gun manufactures, claim: restrictions of gun ownership, violates the Second Amendment. They are clinging to a law that is outdated and prevents common sense gun control.
Like, Speaker of the House Paul Ryan [R-Wis.] recently stated: a ban on assault weapons violates the Second Amendment.
He is an idiot.
The Second Amendment did not mean: preventing terrorists, criminals, and insane people from buying and possessing assault weapons would infringe the Second Amendment. That was a 20th and 21st century unforeseen development.
These are opposites: those that defend the Free State and those that attack the Free State and kill and injury as many people as possible.
For these reasons: the Second Amendment needs to be rewritten to conform to the realities that exist today. We don’t need individuals with assault weapons to form into a well regulated militia to meet the nation’s emergencies: riots, terrorist attacks, and defend the Free State against foreign hostile powers.
We have a justice system, laws, the courts, the police, and numerous layers of specialized militias and armed forces, to protect our human rights and liberties, prevent terror attacks, crime, mass killings, and the defend the Nation.
Plus, we elect our lawmakers and government leaders and we decide important issues by putting them on the ballot.
We no longer settle disputes by dueling.
Therefore, the second Amendment needs to be rewritten; so, we can keep assault weapons and explosives out of the hands of untrained people that are not part of the Nation’s well regulated militias—of the bad guys.
And, the law should state the types of guns individuals can keep and own for hunting and defense of self, home, and businesses.
And, who cannot buy or possess hand guns, rifles, assault weapons, and explosives, etc—who are a potential danger to society, such as: the mentally defective, convicted criminals, suspected terrorists, and anti-government militant groups, like, members of the Black Panther Party, that used weapons for illegal activities, extortion, assassinations, and attacks on the police.
And, who has the right to possess a gun in public
Ninety percent of people want gun control, but the U.S. Congress, a servant of the NRA, the spokesmen for gun manufactures, claim: the Second Amendment--our right to keep and bear arms cannot be infringed. They are out of their minds--crazy.
To begin with, automatic guns have already been banned by the National Firearms Act of 1934. The Gun Control Act of 1986 banned semi-automatic assault weapons for ten years: that ban has expired.
The AR 15 is a semi-automatic weapon that has a magazine that holds up to 30 bullets: it can fire one round every second: it can kill a lot of people in short time: it is an assault weapon: it is not necessary for home protection.
The main opposition comes from gun fanatics: they believe they can protect our Free State from becoming despotic by owning an assault weapon.
Actually, that is absurd.
Nevertheless: individuals, framers, home and business owners should have to right to own a gun for protection of self, family, and property.
And, hunter’s right to own guns for hunting.
The law should limit type of gun, caliber, the number of rounds it can fire, and type of ammunition, the number of guns people can have for these purposes: they don’t need military type assault weapons.
The M4 carbine and Beretta M9 pistol are military weapons. That should set a line of demarcation. The bigger guns that civilians are allowed to own: the bigger guns the police need to protect people, verdad.
But, the U.S. Congress controlled by Republicans which represent the powerful pro-gun lobby, not the majority of people, say, the right of individuals to keep and bear arms shall not be infringed: they are anachronistic morons.
They refuse to pass any limitations.
The make-sense gun control law should specify: who does not have right to keep and bear arms, such as: the DMI, convicted felons, suspected terrorists, gang members, spousal abusers, and members of anti-government militant groups; because, they are a real and potential danger to people and the Free State.
To determine who those people are: you need to kept records and use that national data bank to make background checks.
They don’t use guns for the defense of society and the Free State—intended by the Second Amendment: they used guns to commit crimes: robbery and murder, and attack the Free State; therefore, their right to own arms denied.
The people’s voices should be heard on this issue: the types of guns people should be allowed to buy and possess for self, home, and business protection and who should not be allowed to buy and possess guns.
Bringing the gun control law up-to-date for the protection of people, homes, businesses, neighborhoods, cities, and public places:
I. Optional gun control laws:
A. firearm license required to buy gun
B. must declare all guns possessed
C. number of guns owned restricted
II. Non-optional gun laws:
A. .22 cal guns and bigger require background check
B. can’t buy gun for another person
C. guns used for hunting restricted
D. people can only buy legal guns
E. permit needed carry a concealed weapon
F. private armed guards need a license
II. Other gun laws:
1. Used guns cannot be sold, purchased or traded except through a licensed dealer [or broker]: same laws enforced as new.
2. Ban gun silencers, converting gun to automatic, the making of explosives devices, certain types of ammunition, and magazines that hold more than 5-10 bullets.
3. Draw line between guns civilians can legally buy and possess from those they cannot legally buy and possess; such as those used by the Armed Forces and the well regulated militias: pistols with 15 round magazines, M16 rifles, machine guns, grenades, mortars, bazookas, etc.
4. The right of state governments to require gun registration for the purpose of reducing crime and protecting lives.
5. The federal, state, and local governments together required to maintain a list of people that cannot buy guns [considered dangerous].
6. Need a special permit to buy explosives.
7. The right of states to enact gun control laws that does not violate federal gun laws and the right of cities to enact gun control laws that do not violate state laws.
8. Radical anti-government parties or organizations cannot possess an arsenal of arms unless well regulated by the federal or state governments.
9. Right of government to confiscate illegal arms.
The Second Amendment phrase: "the right of the people to keep and bear arms, shall not be infringed" – is not a separate right of individuals: it is connected to the forming of a well regulated militia necessary for the security of a free State.
The US Congress and the Commander-in-Chief have the right to control the purchase, possession and use of arms by the Armed Forces. Their weapons are bigger and more lethal: howitzers, cruise missiles, ICBMs, and Nukes.
Their main role: fight major wars.
The state legislatures and governors have the right to control the purchase, possession, and use of arms by State Guards. Their weapons are smaller: M16s, grenade launcher, 50 caliber machine guns, armored vehicles, helicopters, etc.
Their main role: put an end to riots, looting, and insurrections.
The city councils and mayors have the right to control the purchase, possession, and use of arms by the local police. Their arms are less lethal: stun guns, bean bag guns, semi automatic pistols and rifles, etc.
Their main role: fight town crimes.
Federal, state, and local governments should have the right to control the purchase, possession, and use of arms [or guns] by civilians:
Their main role:
1. the self protection, their families, homes, and businesses
2. for hunting
3. sports
Today, if the Free State or US was faced with the threat of War: reserves would be called to duty and men could enlist or be drafted into the Armed Forces and trained in hi-tech powerful weapons. That is a big difference from the age of part time citizen-soldiers.
The Second Amendment lacks these arms control measures and contains defective wording: that some claim [or misconstrue] that individuals have the right to keep and bear any type of arms disconnected from serving in a trained and well regulated militia, and that right cannot be infringed –is causing irrational and fierce opposition to common sense arms controls; therefore, needs to be rewritten to conform to today’s realities [or needs] for safer homes, neighborhoods, cities, and nation.

Comment by Two Crows: There are 30,000 gun related deaths per year by firearms, and this number is not disputed. The U.S. population is 324,059,091 as of June 22, 2016. Do the math: 0.00925% of the population dies from gun related actions each year. Statistically speaking, this is insignificant! What is never told, however, is a breakdown of those 30,000 deaths, to put them in perspective as compared to other causes of death:
• 65% of those deaths are by suicide, which would never be prevented by gun laws.
• 15% are by law enforcement in the line of duty and justified.
• 17% are through criminal activity, gang and drug related or mentally ill persons – better known as gun violence.
• 3% are accidental discharge deaths.
So technically, "gun violence" is not 30,000 annually, but drops to 5,100. Still too many? Now lets look at how those deaths spanned across the nation.
• 480 homicides (9.4%) were in Chicago
• 344 homicides (6.7%) were in Baltimore
• 333 homicides (6.5%) were in Detroit
• 119 homicides (2.3%) were in Washington D.C. (a 54% increase over prior years)
So basically, 25% of all gun crime happens in just 4 cities. All 4 of those cities have strict gun laws, so it is not the lack of law that is the root cause.
This basically leaves 3,825 for the entire rest of the nation, or about 75 deaths per state. That is an average because some States have much higher rates than others. For example, California had 1,169 and Alabama had 1.
Now, who has the strictest gun laws by far? California, of course, but understand, it is not guns causing this. It is a crime rate spawned by the number of criminal persons residing in those cities and states. So if all cities and states are not created equal, then there must be something other than the tool causing the gun deaths.
Are 5,100 deaths per year horrific? How about in comparison to other deaths? All death is sad and especially so when it is in the commission of a crime but that is the nature of crime. Robbery, death, rape, assault are all done by criminals. It is ludicrous to think that criminals will obey laws. That is why they are called criminals.
But what about other deaths each year?
• 40,000+ die from a drug overdose–THERE IS NO EXCUSE FOR THAT!
• 36,000 people die per year from the flu, far exceeding the criminal gun deaths.
• 34,000 people die per year in traffic fatalities(exceeding gun deaths even if you include suicide).
Now it gets good:
• 200,000+ people die each year (and growing) from preventable medical errors. You are safer walking in the worst areas of Chicago than you are when you are in a hospital!
• 710,000 people die per year from heart disease. It’s time to stop the double cheeseburgers!
So what is the point? If the liberal loons and the anti-gun movement focused their attention on heart disease, even a 10% decrease in cardiac deaths would save twice the number of lives annually of all gun-related deaths (including suicide, law enforcement, etc.). A 10% reduction in medical errors would be 66% of the total number of gun deaths or 4 times the number of criminal homicides ................ Simple, easily preventable 10% reductions! So you have to ask yourself, in the grand scheme of things, why the focus on guns? It's pretty simple:
Taking away guns gives control to governments. The founders of this nation knew that regardless of the form of government, those in power may become corrupt and seek to rule as the British did by trying to disarm the populace of the colonies. It is not difficult to understand that a disarmed populace is a controlled populace.
Thus, the second amendment was proudly and boldly included in the U.S. Constitution. It must be preserved at all costs. So the next time someone tries to tell you that gun control is about saving lives, look at these facts and remember these words from Noah Webster: "Before a standing army can rule, the people must be disarmed."

When, the constitution was written, then it was: they were standby members of the well regulated Militia: they were called to service with their weapons: it had no standing, separate Army for the defense of the Nation. That is not necessary now.
The Second Amendment needs to be rewritten: it is out dated.

My comment: Based on the video, the man with the permit to carry a concealed weapon, shot the man for pushing him to the ground. It was murder, not self defense. It was unjustified. He was cocky, because, he had a gun, provoked the incident: then, shot the man for no good reason. This is the danger of giving the right to carry a gun to people, who think they have a right to kill you over a minor physical disagreement. He was not under further physical attack. It should have been a warning, first--not revenge for pushing him to the ground, that does not justify killing a person.

The shall not infringement clause only applies to citizens right to keep and bear arms, because, in 1791, the country had no standing Army for defense of the Free State. My Comment: this is not self-defense: it is revenge murder: the video shows the black man backing up when shot--not attacking. Being pushed to the ground, does not justify killing a man. My Reply to Patrick EH: Here is the thing; when, the man pushed to the ground pulled out a gun: that stopped the attack: that is legal: not shooting him, after backing up. Look at the video: that is murder. He should not have the right to carry a concealed weapon: he is the type that looks for trouble--knowing he is armed. He killed a man, after he stopped the attack. My comment [7/26/18]: 2 out of the three Appeal Court judges are idiots: can’t understand plain English: no such right exist in the wording of the Second Amendment. The right to keep and bear arms is for what is necessary for the security of the Free State. Individuals with military weapons are not necessary now, since, he we have active Armed Forces. Then, they relied on citizens with weapons to defend the Free State, since, it had no standing Army. My first comment [7/28]: Neither does Trump or Kavanaugh understand the Second Amendment: written during the Revolutionary War: The Free State had no standing Army to fight the British: it relied on citizens with their muskets to join the well regulated Militia to fight the British—or as guerillas on the home front ; therefore, they were given the right to keep and bear arms under those circumstances at that time.
